The Legal Requirement
What Is an External Transport Manager?

Under UK road transport law, every holder of a standard operator licence — whether national or international — must nominate a professionally competent Transport Manager who holds a valid Certificate of Professional Competence (CPC). This person is legally responsible for the management and organisation of road transport operations under the licence.

Many small and medium-sized operators do not have a CPC-qualified manager employed in-house. An External Transport Manager (ETM) fulfils this legal obligation on behalf of the operator — providing the required professional competence without the cost of a full-time hire.

Legal basis: The requirement for a professionally competent Transport Manager is set out in Regulation (EC) 1071/2009 (as retained in UK law), the Goods Vehicles (Licensing of Operators) Act 1995, and the Public Passenger Vehicles Act 1981. The Senior Traffic Commissioner's Statutory Document No. 3 sets out how TM nominations are assessed and what good management practice looks like in practice.

An external TM can manage up to four operator licences simultaneously under UK rules, subject to Traffic Commissioner scrutiny of the overall management arrangements. BFT's ETMs operate within these limits and maintain full documentation of their management activities across all client licences.

🚚 Who Needs an External Transport Manager?
  • Operators who hold a standard operator licence but have no in-house CPC-qualified manager
  • Growing businesses whose operations have outgrown their current TM capacity
  • Operators whose nominated TM has left the business — a replacement must be nominated within a defined period
  • Operators facing a Public Inquiry who need a professionally competent manager to demonstrate control
  • Operators whose existing TM holds the CPC but is not actively managing — a position the TC will scrutinise
  • New operators requiring a nominated TM to secure licence approval before the first vehicle moves
  • PSV operators — bus, coach, and school transport — requiring a CPC holder for their passenger-carrying licence
ℹ️ Restricted Licence Holders
  • If you hold a restricted operator licence, you are not required to nominate a CPC-qualified Transport Manager
  • However, restricted licence holders still face DVSA scrutiny and must maintain compliant operations
  • BFT Vault is specifically designed to support restricted licence holders with continuous compliance management — without the ETM requirement

What We Provide
External Transport Manager Services

BFT's ETMs do more than satisfy the nomination requirement. We actively manage your compliance position — creating the evidence, systems, and oversight that protects your licence.

📜
TC Nomination & Registration
We complete the formal Transport Manager nomination process with the Office of the Traffic Commissioner, including submission of CPC certificates, management responsibility statements, and supporting documentation required under Statutory Document No. 3.
📋
Active Compliance Management
Ongoing, active management of your transport operations — not just a name on a licence. We monitor compliance standards, review maintenance records, assess driver conduct, and ensure your operation meets the requirements the TC expects an engaged TM to fulfil.
🔧
Maintenance System Oversight
Review and oversight of your preventive maintenance system — PMI schedules, brake test records, defect reporting, and workshop standards. We ensure your maintenance arrangements meet the DVSA Guide to Maintaining Roadworthiness and TC expectations.
⏱️
Drivers' Hours & Tachograph Oversight
Regular review of tachograph data, drivers' hours compliance, and infringement management. We identify patterns, address non-compliance, and produce the management summaries that demonstrate active TM oversight — exactly what the Traffic Commissioner looks for.
👤
Driver Management Support
Support with driver licence checking, DQC verification, induction procedures, disciplinary processes, and driver conduct management. Includes guidance on managing driver hours infringements, prohibition notices, and conduct that could affect the operator's licence.
📄
Policy & Procedures Framework
Development and implementation of operator-specific compliance policies — covering maintenance, drivers' hours, drug and alcohol, mobile phone, load security, and daily walkaround procedures. Customised to your operation and structured to meet TC standards.
⚖️
Public Inquiry Representation
Where a client faces a Traffic Commissioner hearing, BFT's ETMs can appear as expert witnesses alongside legal representatives, provide compliance evidence, and advise on the management position being presented to the TC — often the most critical element of a successful PI outcome.
🔍
Compliance Auditing
Periodic internal compliance audits conducted by your ETM — identifying gaps before DVSA does. Audit reports provide a prioritised action plan and create the written evidence of active management that is central to a sound compliance position.
🚌
PSV-Specific Management
Specialist ETM services for PSV operators — bus, coach, and school transport — covering PSV-specific licence obligations, PSVAR accessibility compliance, local bus registration, and the particular requirements of the Public Passenger Vehicles Act 1981.
